1️⃣ Short Title — कानून का नाम
इस Act को “Bharatiya Nyaya Sanhita, 2023” कहा जाता है।

2️⃣ Commencement — कब लागू हुआ?
Section 1(2) के अनुसार BNS उस date से लागू होती है जिसे Central Government Official Gazette में notification द्वारा appoint करती है।
1 July 2024
Central Government की notification के अनुसार BNS के provisions 1 July 2024 से लागू हुए, लेकिन Section 106(2) उस commencement में exception था।
3️⃣ Intra-Territorial Application — भारत के अंदर
Section 1(3) के अनुसार, जो व्यक्ति India के भीतर BNS के provisions के contrary कोई act या omission करता है, और जिसके लिए वह guilty है, वह BNS के तहत punishment के लिए liable होगा।

4️⃣ Extra-Territorial Jurisdiction — विदेश में हुआ Crime
Section 1(4) उन situations से संबंधित है जहाँ कोई offence India के बाहर किया गया हो लेकिन कोई व्यक्ति भारत में लागू law के अनुसार उस offence के लिए trial के लिए liable हो।
ऐसी स्थिति में उस outside-India act को BNS के provisions के अनुसार ऐसे deal किया जा सकता है जैसे वह act India में किया गया हो।

5️⃣ Section 1(5) — Outside India के 3 Important Cases
BNS Section 1(5)(a) के अनुसार BNS उन offences पर भी apply हो सकती है जो Indian citizen द्वारा India से बाहर किसी स्थान पर किए गए हों।

📖 Section 1 की Explanation
Section 1 की Explanation के अनुसार इस section में “offence” में ऐसा act भी शामिल है जो India के बाहर किया गया हो और यदि वही act India में किया जाता तो BNS के तहत punishable होता।
Outside India किया गया act भी relevant हो सकता है, यदि वही act India में किया जाता तो BNS के तहत punishable होता।
🧑⚖️ Section 1 की Illustration
BNS में illustration के अनुसार, यदि A एक Indian citizen है और वह India से बाहर किसी स्थान पर murder करता है, तो वह India में उस स्थान पर murder के लिए tried और convicted किया जा सकता है जहाँ वह पाया जाए।
Indian Citizen + Murder Abroad → India में जहाँ पाया जाए वहाँ trial/conviction possible, subject to applicable law and procedure.
🌍 Real-World Example 1 — Indian Citizen Abroad
मान लीजिए Ramesh एक Indian citizen है और वह London में ऐसा offence करता है जो BNS के तहत punishable है।
Section 1(5)(a) ऐसी situation को BNS के extra-territorial application framework में शामिल करता है।
यह कहना सही नहीं होगा कि India लौटते ही या extradition के जरिए हर मामले में automatic BNS trial शुरू हो जाएगा। Actual jurisdiction, arrest, extradition, trial और applicable procedural laws facts और अन्य applicable laws पर depend करते हैं।
💻 Real-World Example 2 — Cyber Attack From Outside India
मान लीजिए कोई hacker Russia में बैठकर India में located किसी bank के computer resource/server को target करते हुए offence करता है।
Section 1(5)(c) ऐसी situation को specifically address करता है, क्योंकि offender India के बाहर है लेकिन targeted computer resource India में located है।

6️⃣ Special Laws Exception — Section 1(6)
Section 1(6) यह स्पष्ट करता है कि BNS कुछ existing laws और provisions को affect नहीं करती।
BNS लागू होने का मतलब यह नहीं है कि हर special या local criminal law अपने आप खत्म हो गया।

⏳ Retrospective Effect — 1 July 2024 से पहले के Crimes पर क्या?
BNS को सामान्य रूप से 1 July 2024 से पहले किए गए offences पर पीछे की तारीख से लागू नहीं समझना चाहिए।
इस विषय में BNS Section 358 — Repeal and Savings बहुत important है।
Section 358 ने Indian Penal Code, 1860 को repeal किया। लेकिन repeal के बावजूद पुराने Code के तहत पहले से किए गए acts, accrued rights/liabilities, penalties, punishments, investigations और proceedings को बचाने के लिए savings provisions रखे गए हैं।
“1 July 2024 से पहले किए गए सभी offences automatically BNS के under चले जाएंगे।”
❌ यह statement सही नहीं है।
🇮🇳 क्या BNS Jammu & Kashmir में लागू है?
हाँ। BNS का application Jammu & Kashmir तक भी है। Section 1 में J&K को कोई general exclusion नहीं दिया गया है।
🌐 क्या Foreign Citizen पर भी BNS लागू हो सकती है?
हाँ, circumstances के अनुसार। यदि कोई foreign citizen India के भीतर offence करता है, तो Section 1(3) के territorial application के कारण BNS लागू हो सकती है।
इसके अलावा, Section 1(5)(c) में India के बाहर से India में located computer resource को target करने वाले offence का specific provision है।
हर foreign citizen के हर outside-India act पर BNS automatically apply होगी, ऐसा नहीं है। Section 1 में दिए गए conditions और अन्य applicable laws देखना जरूरी है।
